Reisvoorwaarden Base2Go

Artikel 1 - Definities

Organisator: Base2Go ingeschreven onder KvK nummer 98238213.

Reiziger: iedere persoon die met de Organisator een overeenkomst met betrekking tot een Reis wil sluiten en iedere persoon die op grond van de overeenkomst het recht heeft om te reizen;

Reisdienst: de diensten die onderdeel zijn van de reis, zoals personenvervoer, autohuur, accommodatie en excursies.

Reisdienstverlener: de dienstverlener die een onderdeel van de Reis uitvoert, zoals accommodatieverschaffers, vervoerders, externe gidsen, etc..

Overeenkomst: de overeenkomst die betrekking heeft op de geboekte Reis, inclusief deze Voorwaarden.

Schriftelijk: op schrift of langs elektronische weg waaronder per e-mail.

Voorwaarden: deze algemene voorwaarden.

Pakketreis: een pakketreis in de zin van de wet.

Reis: een Pakketreis of indien de Voorwaarden hierop van toepassing zijn verklaard een enkele Reisdienst, waaronder excursies, retraites, vervoer, uitstapjes.

Werkdagen: maandag t/m vrijdag, met uitzondering van in Nederland erkende feestdagen, binnen werktijden (9u-17u Nederlandse tijd).

Artikel 2 - Toepasselijkheid voorwaarden

2.1    Pakketreizen

Deze Voorwaarden zijn van toepassing op alle door de Organisator aangeboden of met de Organisator overeengekomen Pakketreizen.

2.2   Afwijkende en aanvullende voorwaarden

Afwijkende en aanvullende voorwaarden dienen Schriftelijk te worden overeengekomen en hebben voorrang boven deze Voorwaarden

Artikel 3 - Totstandkoming Overeenkomst

3.1   Inhoud aanbod

De aangeboden Reis omvat enkel de diensten en voorzieningen die in de offerte en publicaties van de Organisator uitdrukkelijk zijn omschreven. Informatie in publicaties van Reisdienstverleners zijn geen onderdeel van het aanbod, ongeacht of er een link naar is opgenomen in het aanbod van de Organisator. De vermelde reisduur staat aangegeven in hele dagen, waarbij de dag van vertrek en aankomst als hele dagen worden geteld.

3.2   Vrijblijvend aanbod

Het aanbod van de Organisator is vrijblijvend en kan na aanvaarding tot 17.00 uur van de eerstvolgende Werkdag worden herroepen door de Organisator.

3.3   De boeking

De Overeenkomst komt tot stand zodra de Reiziger het aanbod van de Organisator aanvaardt en onder voorbehoud van beschikbaarheid van de Reis.  

3.4   Kennelijke fouten

Kennelijke fouten in het aanbod binden de Organisator niet. Indien er reden is tot twijfel dient de Reiziger navraag te doen.

3.5   Voorkeuren

Aan voorkeuren die de Reiziger doorgeeft kunnen geen rechten worden ontleend, tenzij de Organisator Schriftelijk heeft bevestigd aan de voorkeur te voldoen.

De enkele vermelding als voorkeur op reisbescheiden en de boekingsbevestiging is hiertoe onvoldoende.

3.6   Bijzondere vereisten

Indien de Reiziger bij de boeking medische vereisten of andere zwaarwegende belangen als ‘vereiste’ aan de Organisator kenbaar maakt, zal de Organisator beoordelen of deze hieraan kan voldoen. Indien de Organisator niet aan de vereisten kan of wil voldoen zal de Overeenkomst niet tot stand komen. De Organisator kan een prijswijziging doorvoeren in verband met de aangegeven vereisten.  

3.7   Bevestiging van de boeking

De Organisator stuurt na de boeking van de reis en de controle van beschikbaarheid een boekingsbevestiging.

3.8   Herroeping door reiziger

Een boeking van de Reis is definitief. De Reiziger heeft geen recht om de Overeenkomst te herroepen.

3.9   Minderjarigen

De Reiziger die de reis boekt en de reiziger die reist dient meerderjarig (18 jaar of ouder) te zijn.

3.10  Boeken voor andere Reizigers & communicatie

De Reiziger die voor andere Reizigers boekt, is hoofdelijk aansprakelijk voor alle verplichtingen die daaruit voortvloeien. De andere Reizigers zijn ieder voor hun eigen deel aansprakelijk. De bevestiging, de factuur, de reisbescheiden en alle andere communicatie wordt enkel verstuurd naar de Reiziger die de boeking verricht. De Reiziger die de Reis voor anderen boekt, is verplicht relevante persoonlijke omstandigheden van die andere Reizigers bij de boeking door te geven. De Reiziger die de Reis voor anderen boekt, is verplicht die andere Reizigers deze Voorwaarden en andere relevante communicatie te verstrekken. De Reiziger die de reis boekt vrijwaart de Organisator voor schade als gevolg van het niet nakomen van bovenstaande verplichtingen

Artikel 4 - Informatie door de Organisator

4.1   Reissom

Vermelde prijzen gelden per persoon, tenzij uitdrukkelijk anders is vermeld.

4.2   Informatie door de Organisator bij de boeking

Bij de boeking of meteen daarna verstrekt de Organisator de Overeenkomst aan de Reiziger waaronder de geaccepteerde voorkeuren van de Reiziger en op de Nederlandse nationaliteit afgestemde informatie over de benodigde reisdocumenten (paspoorten, visa, etc.) en eventuele formaliteiten op gezondheidsgebied.

4.3   Reisdocumenten

De Reiziger dient gedurende de Reis te beschikken over de noodzakelijke reisdocumenten, zoals een paspoort, visa, vaccinatiebewijzen, etc.. Gelet op het grote belang hiervan, dient de Reiziger bij de officiële instanties te controleren of de informatie volledig en actueel is. De Reiziger dient vóór de boeking van de Reis te controleren of er voldoende tijd is om de benodigde reisdocumenten te verkrijgen. Als de Reiziger de Reis niet of niet geheel kan maken door het ontbreken van de juiste reisdocumenten, komen de kosten voor rekening van de Reiziger. 

4.4   Reisbescheiden

De reisbescheiden (vervoertickets, vouchers, etc.) worden uiterlijk 7 dagen voor vertrek aan de Reiziger toegezonden, tenzij de factuur nog niet volledig is voldaan. Als de Reiziger de reisbescheiden niet 5 dagen voor vertrek heeft ontvangen, dient deze de Organisator meteen op de hoogte te stellen.

4.5   Informatie over verzekeringen

De Reiziger dient te beschikken over een uitgebreide reisverzekering die dekking biedt voor ziektekosten, ongevallen en repatriëring. Dit dient mede sport en avontuurlijke activiteiten te dekken. We adviseren je om een annuleringsverzekering af te sluiten.

Artikel 5 - Informatie door de Reiziger

5.1   Relevante informatie van de Reiziger(s)

Voor de boeking verstrekt de boekende Reiziger alle relevante informatie over de aangemelde Reizigers. In het bijzonder informatie die mogelijk van invloed is op de gezondheid of veiligheid van de Reiziger of anderen. Indien de verstrekte informatie onjuist of onvolledig is kan de Reiziger van deelname worden uitgesloten. De Reiziger dient dan alle kosten en de schade die de organisator lijdt te vergoeden. Andere kosten komen eveneens voor rekening van de Reiziger.

5.2   Verminderde mobiliteit, zwangere vrouwen en ziekte

Reizigers met verminderde mobiliteit en hun begeleiders, zwangere vrouwen en Reizigers met een ziekte die mogelijk effect heeft op de Reis dienen dit bij het aangaan van de Overeenkomst of in ieder geval zo spoedig mogelijk nadat de Reiziger hiermee bekend is te melden bij de Organisator in verband met eventuele gevolgen voor de Reis en in het bijzonder het luchtvervoer. Deze Reizigers dienen zelf bij de vervoerder te verifiëren of er een medische verklaring nodig is om te mogen reizen.

Artikel 6 - Betaling

6.1   Aanbetaling

De Organisator verlangt een aanbetaling zoals vermeld in het aanbod. Deze dient te worden voldaan bij de boeking.

6.2   Restantbetaling

Het restant van de reissom dient uiterlijk 8 weken voor aanvang van de Reis te zijn ontvangen door de Organisator. Bij boeking binnen 8 weken voor aanvang van de Reis dient de volledige reissom direct na de boeking te worden voldaan. In ieder geval dient de gehele betaling voor aanvang van de Reis te zijn ontvangen.

6.3   Verzuim en rente

            Indien de Reiziger niet betaalt binnen de afgesproken termijn is de Reiziger zonder dat een nadere ingebrekestelling is vereist in verzuim en is over het openstaande bedrag de wettelijke rente verschuldigd.

6.4   Incassokosten

De Reiziger dient buitengerechtelijke incassokosten te betalen indien deze niet betaald heeft binnen de uiterste betalingstermijn die via een Schriftelijke aanmaning is gesteld. De buitengerechtelijke incassokosten bedragen: 15% van het gevorderde tot €2500, 10% over de daaropvolgende € 2500, 5% over de daaropvolgende € 5000 en 1% over het meerdere.

6.5   Verdere gevolgen van uitblijven van betaling

Zolang de Reiziger niet betaald heeft, kan de Organisator de reisbescheiden onder zich houden. Indien betaling ook na aanmaning uitblijft of indien niet voor aanvang van de reis is betaald, kan de Organisator de Reiziger uitsluiten van deelname. De verplichting tot betaling blijft bestaan. In plaats van de Reiziger uit te sluiten van deelname kan de Organisator de Overeenkomst annuleren en de Reiziger alle kosten en de schade die de organisator lijdt in rekening brengen.

Artikel 7 - Indeplaatsstelling

7.1   Voorwaarden en kennisgeving

Een Reiziger kan de Reis overdragen aan een andere persoon. De andere persoon moet  voldoen aan alle aan de Reis verbonden voorwaarden. Overdracht is slechts mogelijk voor zover de voorwaarden van de betrokken Reisdienstverlener dit toelaten. Indien vliegtickets onderdeel zijn van de Reis is overdracht van de vliegtickets vaak niet mogelijk. Overdracht van de Reis is dan mogelijk indien - op kosten van de Reiziger - nieuwe vliegtickets worden geboekt. De Reiziger verzoekt de Organisator uiterlijk 7 dagen voor de Reis om de persoon in de plaats te stellen.

 7.2   Hoofdelijke aansprakelijkheid en extra kosten

De Reiziger en degene die de Reis overneemt, zijn hoofdelijk aansprakelijk voor de betaling van de reissom en bijkomende kosten die voortvloeien uit de indeplaatsstelling, waaronder wijzigingskosten.

Artikel 8 - Wijziging op verzoek van de Reiziger

8.1   Wijziging

De Reiziger die de Reis heeft geboekt, kan de Organisator verzoeken de Overeenkomst te wijzigen. De Organisator is hier niet toe verplicht. De Organisator stelt de Reiziger op de hoogte van de nieuwe reissom. Indien de Reiziger akkoord gaat met de kosten van de wijziging zijn de nieuwe reissom en wijzigingskosten verschuldigd. Indien de nieuwe reissom lager uitvalt dan de oorspronkelijke reissom, wordt het verschil verrekend met de verschuldigde wijzigingskosten.

8.2   Wijziging vertrekdatum

Tenzij de Organisator aangeeft dat er sprake is van een omboeking, vormt de wijziging van de vertrekdatum de annulering van de bestaande overeenkomst en de totstandkoming van een nieuwe overeenkomst. De annuleringsregeling van artikel 9 [annuleringskosten] is op de geannuleerde overeenkomst van toepassing

Artikel 9 - Annulering door de Reiziger

9.1   Annulering

De Reiziger kan de boeking voor aanvang van de Reis annuleren. Annulering dient Schriftelijk te geschieden. De datum waarop de annulering door de Organisator wordt ontvangen, geldt als het moment van annulering. Bij ontvangst na 17.00u of buiten Werkdagen om wordt de volgende Werkdag gezien als de datum van ontvangst.

9.2   Annuleringskosten

Indien de Reiziger de Reis annuleert, is de Reiziger het volgende verschuldigd:

a. tot en met 85 dagen vóór de dag van vertrek: de aanbetaling; 
b. vanaf 84 dagen tot en met 46 dagen vóór de dag van vertrek: 50% van de reissom; 
c. vanaf 45 dagen tot en met 22 dagen vóór de dag van vertrek: 75% van de reissom; 
d. vanaf 21 dagen voor vertrek: 100% van de reissom.

9.3   Vermindering aantal reizigers

Indien binnen één boeking het aantal Reizigers wordt verminderd, kan de Organisator naar keuze als annuleringskosten in rekening brengen:

  1. de in lid 2 van dit artikel genoemde standaardannuleringskosten, of;

  2. de gehele reissom van de geannuleerde persoon min de kostenbesparingen als gevolg van de annulering.

9.4   Annuleringskosten bij annulering ná een omgeboekte reis

Het kan voorkomen dat de Reiziger en Organisator de reis omboeken naar een later moment. Als de Reiziger de omgeboekte reis annuleert, bedragen de annuleringskosten tenminste het bedrag dat verschuldigd zou zijn als op de datum van omboeking zou zijn geannuleerd.

9.5    Reistegoeden die uit coulance zijn uitgegeven

Indien een Reis is geannuleerd door de Reiziger en er uit coulance een reistegoed wordt toegekend, geldt (tenzij andere voorwaarden door de Organisator worden gecommuniceerd):

- het reistegoed dient binnen één jaar na toekenning van het reistegoed te zijn besteed.

- de nieuwe reis dient binnen twee jaar na toekenning van het reistegoed te zijn aangevangen.

- het reistegoed is gebonden aan de Reiziger en niet overdraagbaar.

- het reistegoed kan enkel worden ingezet voor dezelfde Reis op een later moment.

- indien de reis op een later moment duurder is, wordt het prijsverschil doorbelast aan de Reiziger.

- indien de Reiziger de Reis annuleert die is geboekt met een uit coulance toegekend reistegoed vervalt het reistegoed.

Artikel 10 - Prijswijziging

10.1  Prijswijziging

De Organisator kan tot 20 dagen vóór aanvang van de Reis de reissom verhogen als gevolg van prijswijzigingen in:

- kosten van brandstof of andere energiebronnen, of;

- belastingen of vergoedingen van niet direct bij de uitvoering van de Reis betrokken derden. De Organisator kan in de Overeenkomst opnemen dat hij tot 20 dagen vóór aanvang van de Reis de reissom kan verhogen op grond van wijzigingen in wisselkoersen. In de Overeenkomst dient de methode van prijsherberekening op grond van de wisselkoers te zijn opgenomen.

10.2  Beëindiging door Reiziger

Indien de prijsverhoging meer dan 8% van de reissom bedraagt, kan de Reiziger de Overeenkomst beëindigen en krijgt de Reiziger de betaalde reissom terug.

10.3  Prijsverlaging

Indien het recht op prijsverhoging is afgesproken, heeft de Reiziger een overeenkomstig recht op prijsverlaging. Op het bedrag wat de Reiziger toekomt, wordt 30 euro administratiekosten ingehouden.

Artikel 11 - Wijziging door de Organisator

11.1  Wijzigingen

De Organisator kan voor aanvang van de Reis eenzijdig kleine wijzigingen in de Reis doorvoeren. De Reiziger wordt hiervan op de hoogte gesteld.

11.2  Ingrijpende wijzigingen

Indien noodzakelijk kan de Organisator voor aanvang van de Reis de voornaamste kenmerken ingrijpend wijzigen. Hieronder valt eveneens het aanbieden van een alternatieve Reis. De Reiziger kan de wijziging aanvaarden of de Overeenkomst beëindigen zonder betaling van annuleringskosten. Bij beëindiging wordt de door de Reiziger betaalde reissom terugbetaald. De Organisator kan de Reiziger een redelijke termijn stellen waarbinnen de Reiziger zijn keuze duidelijk dient te maken. Wordt de Overeenkomst niet binnen de gestelde termijn beëindigd, geldt de wijziging als aanvaard en vervalt het recht op beëindiging

Artikel 12 - Annulering door de Organisator

12.1  Annulering i.v.m. minimale aantallen

De Organisator kan de Overeenkomst vóór aanvang van de Reis annuleren als het aantal aanmeldingen kleiner is dan het in de Overeenkomst vermelde minimumaantal en de Reiziger op de hoogte wordt gebracht, uiterlijk:

- 20 dagen voor aanvang van de Reis bij een Reis van 6 dagen of meer.

- 7 dagen voor aanvang van de Reis bij een Reis van 2 tot 6 dagen.

- 48 uur voor aanvang van de Reis bij een Reis van minder dan 2 dagen.

12.2  Annulering i.v.m. overmacht

De Organisator kan de Overeenkomst vóór aanvang van de Reis annuleren als de Organisator de overeenkomst niet kan uitvoeren als gevolg van onvermijdbare en buitengewone omstandigheden.

12.3  Terugbetaling betaalde reissom – geen schadevergoeding

In de bovenstaande gevallen betaalt de Organisator reeds ontvangen bedragen binnen 14 dagen terug en is er geen schadevergoeding verschuldigd. Niet vergoed worden kosten die door de Reiziger zijn gemaakt voor diensten die buiten de Overeenkomst vallen zoals inentingen, visa, aanschaf materiaal, verzekeringen en indien niet bij de Reis inbegrepen de vliegreis, tickets, accommodatie, e.d..

12.4  Annulering door toedoen van de Reiziger

Als de Reiziger niet voldoet aan vooraf gestelde deelname-eisen of indien onjuiste of onvolledige informatie over de Reiziger is opgegeven, kan de Organisator de Overeenkomst annuleren. De Reiziger dient dan alle kosten en de schade die de organisator lijdt te vergoeden.

Artikel 13 – Verantwoordelijkheid & tekortkomingen

13.1  Goede uitvoering van de Reis

De Organisator is verantwoordelijk voor de uitvoering van de overeengekomen Reisdiensten, ongeacht of deze door de Organisator zelf of door een andere Reisdienstverlener worden uitgevoerd. De Organisator dient de Overeenkomst uit te voeren overeenkomstig de verwachtingen die de Reiziger op grond van de publicaties, de Overeenkomst en de omstandigheden op de reisbestemmingen redelijkerwijs mocht hebben.

13.2  Wijzigingen in reisschema en reistijden

De Organisator zal de Reiziger informeren over wijzigingen in het reisschema. Indien de Organisator niet op de hoogte is van de plaats van verblijf zal de Reiziger enkel worden geïnformeerd op het bij de Organisator bekende e-mailadres of mobiele telefoonnummer.

13.3  Klachtplicht reiziger

De Reiziger stelt de Reisdienstverlener en de Organisator in lijn met artikel 17 [klachten] direct in kennis van gebreken of problemen bij de uitvoering van de Reisdiensten.

13.4  Oplossing door de Organisator

De Organisator zorgt dat tekortkomingen worden verholpen. Een tekortkoming hoeft niet te worden verholpen als dit onmogelijk is of dit onevenredig hoge kosten met zich meebrengt.

13.5  Compensatie

Indien de tekortkoming niet kan worden opgelost, zal de Organisator (of Reisdienstverlener) in overleg treden met de Reiziger en kan deze waar gepast een compensatie of alternatief regelen. De Reiziger heeft geen recht op compensatie of alternatief indien de tekortkoming is toe te rekenen aan de Reiziger.

Artikel 14 - Hulp en bijstand

14.1  Verplichte bijstand

De Organisator verleent de Reiziger hulp en bijstand indien de Reiziger in moeilijkheden verkeert, in het bijzonder door goede informatie te verstrekken over medische diensten, plaatselijke autoriteiten en consulaire bijstand en door de Reiziger te helpen bij het gebruik van communicatie op afstand en bij het vinden van alternatieve reisarrangementen.

14.2  Kosten

De Organisator brengt voor de hulp en bijstand een redelijke vergoeding in rekening indien de moeilijkheden zijn ontstaan door opzet of nalatigheid van de Reiziger

Artikel 15 - Toerekening, overmacht en aansprakelijkheidsuitsluitingen

15.1  Toerekening & overmacht
De Reiziger heeft geen recht op vergoeding van schade die de Reiziger oploopt als gevolg van een tekortkoming die is te wijten aan:
a. de Reiziger;
b. derden die niet direct bij de uitvoering van de Overeenkomst zijn betrokken en de tekortkoming niet kon worden voorzien of voorkomen, of; 
c. onvermijdbare en buitengewone omstandigheden.
15.2  Aansprakelijkheidsuitsluiting
Iedere aansprakelijkheid van de Organisator voor schade is beperkt tot driemaal de reissom, tenzij de schade volgt uit het overlijden of persoonlijk letsel van de Reiziger of de schade is veroorzaakt door opzettelijk dan wel nalatig handelen van de Organisator.
15.3  Aansprakelijkheidsuitsluiting krachtens verdrag of EU-verordening
Indien de Organisator aansprakelijk is voor enige schade, waaronder ook schade die volgt uit het overlijden of persoonlijk letsel van de Reiziger, zal deze aansprakelijkheid beperkt of uitgesloten zijn tot de grenzen die zijn toegestaan volgens de ter zake geldende internationale verdragen en/of EU-verordeningen die betrekking hebben op de individuele Reisdiensten.
15.4  Verzekerde schade
De Organisator is niet aansprakelijk voor schade die is gedekt door verzekeringen, zoals zorg-, reis-, evenementen-, of annuleringsverzekeringen. 
15.5  Verjaring
Iedere aanspraak van de Reiziger op vergoeding van schade en andere vorderingen van de reiziger verjaren twee jaar nadat de Reis heeft plaatsgevonden. Indien de Reis geen doorgang vond verjaart het twee jaar na de geplande datum van aanvang.
15.6  Verval van recht
Zonder afbreuk te doen aan de verjaringstermijn en de plicht om tijdig te klagen geldt dat iedere aanspraak van de Reiziger op vergoeding van schade drie jaar na de aanvangsdatum van de Reis vervalt.
15.7  Geen dubbele compensatie
De Reiziger heeft geen recht op dubbele compensatie. Als de Reiziger recht heeft op compensatie op grond van internationale verdragen of EU-verordeningen krijgt de Reiziger niet ook nog een compensatie op grond van deze Overeenkomst.

Artikel 16 - Verplichtingen Reiziger

16.1  Gedrag en opvolging van aanwijzingen

De Reiziger dient zich als een redelijk handelend Reiziger te gedragen en is verplicht alle aanwijzingen van de Organisator en de Reisdienstverleners op te volgen.

16.2  Gevolgen niet naleving – uitsluiting van deelname

Bij niet naleving van aanwijzingen of in het geval een Reiziger overlast veroorzaakt, kan de Organisator/Reisdienstverlener de Reiziger de verdere deelname aan de Reis gedeeltelijk of geheel ontzeggen. De Reiziger dient dan alle kosten en de schade die de organisator lijdt te vergoeden. Verdere hierdoor ontstane kosten komen voor rekening van de Reiziger.

16.3 Waarschuwing

Voordat de Reiziger wordt uitgesloten van deelname, krijgt de Reiziger eerst een mondelinge of schriftelijke waarschuwing. Een waarschuwing is niet vereist indien dit gegeven de omstandigheden niet op zijn plaats is.

16.4  Aansprakelijkheid reiziger en vrijwaring

De Reiziger is aansprakelijk voor schade veroorzaakt door zijn gedrag, het niet nakomen van de verplichtingen in dit artikel of schade die anderszins aan hem moet worden toegerekend. De Reiziger vrijwaart de Organisator van aanspraken van bij de Reis betrokken Reisdienstverleners, andere Reizigers of derden voor schade die door de Reiziger is veroorzaakt of aan hem moet worden toegerekend.

16.5  Controle tijdstip terugreis

De Reiziger dient uiterlijk 24 uur voor de geplande aanvang van de terugreis het exacte tijdstip van vertrek te verifiëren.

16.6  Formele gezondheidseisen

De Reiziger dient te voldoen aan alle op de bestemming (en doorreislanden) geldende gezondheidseisen. Overheden kunnen deze vereisten onaangekondigd wijzigen. De gevolgen van deze wijzigingen vallen binnen de risicosfeer van de Reiziger.

16.7  Maatregelen door Reisdienstverleners

Reisdienstverleners kunnen alle redelijke maatregelen nemen en medewerking van Reizigers verlangen, onder meer ter voorkoming en bestrijding van calamiteiten, ter beperking van gezondheidsrisico’s, ter voorkoming van schade dan wel ter naleving van overheidsvoorschriften. Bij het niet-naleven van de maatregelen of aanwijzingen kan de Reiziger de Reisdienst en de toegang worden ontzegd.

16.8 Gebruik van materiaal en accommodatie

De Reiziger dient netjes met verstrekte materialen en accommodatie en om te gaan. Bij ontvangst dient de Reiziger deze zaken te controleren en gebreken direct te melden. De Reiziger is aansprakelijk voor beschadiging, verlies of diefstal van het ter beschikking gestelde materiaal.

Artikel 17 - Klachten

17.1  Informatie

De Organisator verstrekt voor aanvang van de Reis de contactgegevens voor noodgevallen.

17.2  Melden ter plaatse

Indien de Reiziger meent dat de Reis niet goed wordt uitgevoerd, dient hij het probleem of gebrek meteen te melden bij de betrokken Reisdienstverlener zodat deze een oplossing kan bieden. De klacht dient ook meteen bij de vertegenwoordiger van de Organisator (Host) te worden gemeld. Indien er geen vertegenwoordiger ter plaatse is of de klacht gaat over de vertegenwoordiger, dient de klacht bij de Organisator te worden gemeld per Whatsapp of op Werkdagen onder Nederlandse kantoortijden (9-17u) ook per e-mail aan info@base2go.com  

17.3  Communicatiekosten

De Reiziger dient eventuele communicatiekosten te beperken onder meer door gebruik te maken van bellen via internet, WhatsApp en e-mail.

17.4  Niet verholpen klacht melden na terugkomst

Alle klachten die volgens de Reiziger niet volledig zijn verholpen of gecompenseerd tijdens de Reis, dienen binnen twee maanden na de Reis, Schriftelijk en met redenen omkleed bij de Organisator te zijn ingediend.

17.5  Gevolgen niet of niet tijdig melden van de tekortkoming of klacht

Het niet of niet tijdig klagen overeenkomstig het tweede lid [Melden ter plaatse] van dit artikel kan van invloed zijn op de hoogte van een eventuele compensatie, tenzij de belangen van de Organisator door het niet tijdig klagen niet geschaad zijn. Klachten die na terugkomst niet tijdig zijn ontvangen worden niet in behandeling genomen, tenzij dit in de omstandigheden van het geval niet redelijk is

Artikel 18 – Foto’s, video’s en off- en online publicaties.

18.1  Beelden en het gebruik ervan

De Reis die door de Organisator wordt aangeboden, is georganiseerd in samenwerking met influencers die actief zijn op sociale media. Door deel te nemen aan de reis ga je ermee akkoord dat je gefotografeerd en gefilmd wordt in openbare ruimtes en gedeelde faciliteiten, en dat je mogelijk verschijnt in online producties van de influencers of in online of offline marketing/publicaties van de Organisator. Dit geldt voor beelden en het gebruik daarvan zoals je redelijkerwijs mag verwachten. Het geldt niet voor je privéruimte/kamer en niet voor beelden of publicaties die aanstootgevend zijn.

18.2  Jouw beelden – enkel voor privégebruik

De beelden (foto's en video's) die je tijdens de reis maakt of verkrijgt, mogen uitsluitend voor privédoeleinden worden gebruikt. Commerciële activiteiten of commerciële exploitatie van deze beelden zijn verboden zonder voorafgaande toestemming van de Organisator

Artikel 19 - Overige bepalingen

19.1  Rechten van derden
Ondergeschikten, hulppersonen en andere bij de uitvoering van de Overeenkomst betrokken derden kunnen zich richting de Reiziger beroepen op de bepalingen uit de Overeenkomst en deze Voorwaarden (met inbegrip van de aansprakelijkheidsuitsluitingen).
19.2  Vervangende bepalingen
Indien dwingend recht aan de geldigheid van een bepaling in deze Voorwaarden in de weg staat of indien een bepaling wordt vernietigd, wordt die bepaling geacht te zijn omgezet naar een geldige bepaling die qua inhoud en strekking zo dicht mogelijk de oorspronkelijke bedoeling benadert.
19.3  Toepasselijk recht
Op het aanbod, de Overeenkomst en de uitvoering van de Overeenkomst is uitsluitend Neder­lands recht van toepassing, tenzij dit in strijd is met dwingend recht.
Indien de consument ten tijde van de boeking buiten Nederland woont, geldt: Ondanks de rechtskeuze komt de consument de bescherming toe die het dwingend recht van het land van zijn woonplaats hem biedt indien (cumulatief):
- de Organisator de commerciële activiteiten voor de overeengekomen Reis richtte op het land waar de consument woonplaats heeft, én;
- de overeengekomen reisdiensten gedeeltelijk of geheel worden verricht in dat land.
19.4  Bevoegde rechter
De rechtbank binnen wiens werkgebied de vestigingsplaats van de Organisator is gelegen, is exclusief bevoegd kennis te nemen van geschillen inzake de Overeenkomst en hetgeen daarmee samenhangt, tenzij dit in strijd is met dwingend recht. Het is de Organisator daarnaast toegestaan de Reiziger in haar woonplaats voor het gerecht te dagen.

General Terms & Conditions Base2Go

Article 1 - Definitions

Organiser: Base2Go registered under Chamber of Commerce number 98238213

Traveller: any person who is seeking to conclude a Contract with the Organiser or any person who is entitled to travel on the basis of the Contract.

Travel service: the services that are part of the Trip, such as carriage of passengers, rental of motor vehicles, accommodation and excursions.

Travel service provider: The service provider that executes part of the Trip such as facilitators of accommodation, transport service providers, external guides, etc.). 

Contract: the agreement regarding the booked Trip, including these Terms & conditions.

Written: in writing or by electronic means including e-mail.

Terms & conditions: these General Terms and conditions.

Package: a travel package (“pakketreis”) in the sense of article 7:500 sub b of the Dutch Civil Code.

Trip: a package or if the Terms & conditions are applied a sole Travel service, including trips, retreats, journeys, tours.

Working days: Monday to Friday, with the exemption of Dutch public holidays, within office hours (9h-17h Dutch time).

Article 2 – Applicability of the Terms & conditions

2.1      Package travel

The Terms & conditions are applicable to all Packages offered by or concluded with the Organiser.

2.2     Derogation of the Terms & condition and additional terms and conditions

Derogation of the Terms & condition and additional terms and conditions are only valid in Written form and are superseding the conditions in these Terms & conditions.

Article 3 – Formation of the contract

3.1     Content of the offer

The offer of the Trip only contains the services and facilities that are explicitly mentioned in the offer and publications of the Organiser. Information in publications of Travel service providers are not part of the offer, whether or not there is a link provided to these publications in the offer of the Organiser. The period of the Trip is stated in whole days. The day of departure and arrival are counted as whole days.

3.2     Non-binding offer

The offer made by the Organiser is non-binding. After the offer has been accepted, the offer can be revoked by the Organiser until 17.00h of the next Working day.

3.3     Booking

De Contract is concluded after the Traveller has accepted the offer of the Organiser and subject to availability of the Trip.  

3.4     Apparent errors

Apparent errors in the offer do not bind the Organiser. If there is any reason for doubt, the Traveller should enquire with the Organiser.

3.5     Preferences

Preferences communicated by the Traveller are non-binding and do not create rights, unless the Organiser confirms in Writing that the preference shall be honoured. The sole reference as a preference on travel documents and the booking confirmation does not constitute this acceptance.

3.6     Special requirements

If the Traveller communicates medical requirements or other compelling interests as a ‘requirement’ to the Organiser before booking, the Organiser shall assess whether or not it can comply. If the Organiser cannot or does not want to comply, the contract shall not be concluded. The Organiser can alter the price of the trip due to the communicated requirements.

3.7     Confirmation of the booking

The Organiser will send a confirmation of the booking after the booking of the Trip and the check of availability.    

3.8     Revocation by the Traveller

A booking made by the Traveller is irrevocable. The Traveller has no right of withdrawal of the Contract.

3.9     Minors

The person who books and the Traveller who travels, has to be adult (18 yrs. or older).

3.10    Booking for other Travellers & communication

The Traveller that books for other Travellers, is fully liable for all obligations that arise from it. The other Travellers are liable for their own part. The booking confirmation, invoice, travel documents and other communication are only send to the Traveller that made the booking. The Traveller who books the Trip for others, is obligated to communicate all relevant personal information of those other Travellers. The Traveller who books the Trip for others, is obligated to send these Terms & conditions and all other relevant communication to those Travellers. The Traveller that made the booking indemnifies the Organiser for all damages that arise as a result of not performing the obligations stipulated in this provision.

Article 4 - Information provided by the Organiser

4.1     Price

Indicated prices are per person, unless specifically stated otherwise.

4.2     Information during the booking process

Before or immediately after the conclusion of the Contract the Organiser provides the Traveller the Contract including accepted preferences, information on the travel documents needed (passport, visa, etc.) and health related formalities. This information is based on the Dutch nationality.

4.3     Travel documents

During the Trip the Traveller shall possess the necessary Travel documents, such as a passport, visa, vaccination, etc.. Due to the great importance, the Traveller has to verify with the relevant authorities whether the information is complete and up to date. The Traveller has to verify before booking whether or not there is sufficient time to obtain the necessary travel documents. If the Traveller cannot execute the Trip or parts of it due to the absence of the required travel documents, the arising costs will be borne by the Traveller.

4.4     Travel vouchers

The travel vouchers (transport tickets, vouchers, etc.) will be send to the Traveller at least 7 days before departure unless the invoice is not yet fully paid. If a Traveller has not received their travel vouchers 5 days before departure the Traveller has to inform the Organiser immediately.

4.5     Information on insurance

You must take out a comprehensive travel insurance policy that includes medical expenses, accidents, and repatriation. This must also cover the sporting and adventurous activities. Additionally, we recommend taking out a cancellation insurance policy.

Article 5 – Information to be provided by the Traveller

5.1     Relevant information of the Traveller(s)

Before booking the Traveller who books the Trip provides all relevant information of the Travellers. In particular information that can be of influence to the health and safety of the Traveller or others. If the information provided is incorrect or incomplete the Traveller can be excluded from participation. In that case the Traveller has to pay all costs and damages the organiser has incurred. Other costs arising from this will be borne by the Traveller as well.

5.2     Reduced mobility, pregnant women and illness

Travellers with reduce mobility and the persons that accompany them, pregnant women, and Travellers with illness with a possible effect on the Trip have to indicate this to the Organiser before the conclusion of the Contract or at least as soon as the Traveller takes notice because of possible effects on the Trip and especially air travel. The Traveller has to verify themselves if they need a medical statement that allows them to travel.

Article 6 - payment

6.1     Down payment

The Organiser will require a down payment as stated in the offer, which is due upon booking.

6.2     Payment of the remaining amount

The remaining amount of the price of the Trip has to be received by the Organiser at the latest 8 weeks before the start of the Trip. If the Trip is booked within 8 weeks before the start of the Trip, the full price shall be paid immediately after booking. In all circumstances full payment has to be received before the start of the Trip.

6.3     Default and interest

If the Traveller has not paid before the agreed term, the Traveller shall be in default without any prior notice of default. From that moment statutory interest is due over the outstanding amount.

6.4     Extrajudicial collection costs

The Traveller has to pay extrajudicial collection costs if the Traveller has not paid before the final date, which was communicated by means of a formal Written reminder. The extrajudicial collection costs are: 15% of the amount of the claim up to € 2500, 10% of the subsequent €2500, 5% of the subsequent €5000 and 1% of the excess amount of the claim.

6.5     Further consequences of non-payment

As long as the Traveller has not paid the due amount, the Organiser can suspend sending the travel vouchers without further notice. If payment is not made after having send a formal reminder or if full payment has not been received before the start of the Trip, the Organiser can exclude the Traveller from participation. The obligation to pay remains in force. Instead of excluding the Traveller from participating, the Organiser can cancel the Contract and claim all costs and damages it has incurred.

Article 7 – Transfer of the Trip

7.1     Conditions and notification

A Traveller can transfer the Trip to another person who meets all conditions applicable to the Trip. Transfer of the Trip is only possible as far as the terms and conditions of the Travel service providers allow this. If flight tickets are part of the Trip, then transfer of the flight ticket is often not possible. Transfer of the whole Trip is then only possible if a new flight ticket is booked at the expense of the Traveller. The Traveller shall request the transfer at the latest 7 days before the start of the Trip.

7.2     Joint and several liability and extra costs

The Traveller and the person who agrees to take over the Trip, have a joint and several liability for the payment of the price and additional costs that arise as a result of the transfer, including costs for the alteration.

Article 8 – Alteration requested by the Traveller

8.1     Alteration

The Traveller who has booked the Trip can request the Organiser in Writing to alter the Contract. The Organiser is not bound to alter the Contract. The Organiser will inform the Traveller of the new price for the Trip. If the Traveller agrees on the costs of the alteration than the new price and alteration costs are due. If the new price is lower than the initial price then the difference is offset with the alteration costs.

8.2     Changing the date of departure

Unless the Organiser states the alteration constitutes a rebooking, the change of the departure date constitutes a cancellation of the contract and the conclusion of a new contract. The cancellation policy as set out in article 9 paragraph 2 [cancellation costs] is applicable to the cancelled contract.

Article 9 – Cancellation by the Traveller

9.1     Cancellation
The Traveller can cancel the booking at any time before the start of the Trip. The cancellation shall be in Writing. The day of reception of the cancellation by the Organiser, shall constitute the cancellation date. When the reception occurs after 17.00h (Amsterdam-time) or outside of Working days, the next Working day shall be the day of reception of the cancellation.
9.2     Cancellation costs
If the Traveller cancels the trip, the Traveller is due:
a. until 85 days before the day the Trip starts: the downpayment. 
b. from 84 days up to 46 days before the day the Trip starts: 50% of the price of the Trip. 
c. from 45 days up to 22 days before the day the Trip starts: 75% of the price of the Trip. 
d. from 21 days before the start of the Trip: 100% of the price of the Trip.
9.3     Decreasing the number of travellers
When decreasing the number of Travellers within in a booking, the Organiser can, at its own choice, charge either one of the following cancellation costs:

  1. the standard cancellation costs as stipulated in paragraph 2 of this article;

  2. the full price of the cancelled Trip minus any savings as a result of the cancellation.   

9.4     Cancellation costs when cancelling a rebooked Trip
In the event the Traveller and Organiser rebook the Trip to a later moment the following applies: If the Traveller cancels the rebooked Trip, the cancellation costs shall at least be the amount the Traveller would have to pay if the Traveller would have cancelled the day of rebooking.
9.5     Travel credits based on leniency policy
If the Trip is cancelled by the Traveller and out of leniency travel credits are attributed to the Traveller, the following provisions apply (unless other provisions are communicated):

  • the travel credit shall be used within one year after its issue.

  • the new Trip has to commence within two years after the issue of the travel credit.

  • the travel credit is personal and not transferable.

  • the travel credit can only be used for the same Trip at a later moment.

  • if the Trip is more expensive at a later moment, the price difference will be charged to the Traveller.

  • If the Traveller cancels a Trip that is booked with travel credits that were issued out of leniency, the travel credit expires.

Article 10 – Alteration of the price

10.1    Alteration of the price

The Organiser can increase the price of the Trip until 20 days before the start of the Trip due to a price revision of:

-the cost of fuel or other power sources, or;

- taxes or fees imposed by third parties not directly involved in the performance of the Contract.

The Organiser can reserve the right in the Contract to increase the price of the Trip until 20 days before the start of the Trip as a consequence of changes in the exchange rate. The method for calculating the price revision shall be included in the Contract.

10.2    Termination by the Traveller

If the price increase exceeds 8% of the Price of the Trip, the Traveller can terminate the Contract. In that case the paid price of the Trip is refunded to the Traveller.

10.3    Price reduction

If the right to a price increase is agreed, the Traveller has a corresponding right to a price reduction. An administrative expense of 30 euro shall be deducted from the refund that the Traveller is entitled to based on the price reduction.

Article 11 – Alterations made by the Organiser

11.1    Alteration

The Organiser can unilaterally make changes to the Contract before the start of the Trip as far as these alterations are insignificant. These alterations will be communicated to the Traveller.

11.2    Significant alteration

If necessary the Organiser can alter significantly the main characteristics of the Contract before the start of the Trip. This includes offering a substitute Trip. The Traveller can accept the alteration or cancel the Contract without payment of cancellation costs. If cancelled, the paid price of the Trip is refunded to the Traveller. The Organiser may specify a reasonable period within which the Traveller has to communicate its choice. If the Contract is not cancelled within the specified period, the alteration shall be deemed accepted and the right to cancel the Contract expires.

Article 12 – Cancellation by the Organiser

12.1    Minimum number of Travellers

The Organiser can cancel the Contract before the start of the Trip, if the number of persons enrolled for the Trip is smaller than the minimum number stated in the Contract and the Organiser notifies the Traveller of the cancellation of the Contract not later than:

- 20 days before the start of the Trip in case the Trip lasts more than 6 days

- 7 days before the start of the Trip in case the Trip lasts between 2 and 6 days

- 48 hours before the start of the Trip in case the Trip lasts less than 2 days

12.2    Cancellation due to Force Majeure

The Organiser can cancel the Contract before the start of the Trip, in the event of force majeure, which is defined as unavoidable and extraordinary circumstances.

12.3    Refund of the price of the Trip – no compensation for damages

In the aforementioned events, the Organiser will refund the payment of the Trip within 14 days and no compensation for damages is due. No refund will be made for services not included in the Contract such as vaccinations, visa, materials bought, insurance and if not included in the Trip flights, tickets, accommodation, a.s.o..

12.4    Cancellation that is attributable to the Traveller

If the Traveller does not meet the predefined conditions of participation or the information of the Traveller regarding experience, skills, physical or mental condition or other relevant subjects that has been communicated is incomplete or erroneous, the Organiser can cancel the Contract. The Traveller has to pay all costs and damages the Organiser has incurred due to the cancellation.

Article 13 – Responsibility & lack of conformit

13.1    Proper performance of the Trip

The Organiser is responsible for the performance of the contracted Travel services, irrespective of whether those services are to be performed by the Organiser or by other Travel service providers. The Organiser shall perform the Contract in accordance with the reasonable expectations of the Traveller based on the publications, the Contract and the circumstances at the destinations.

13.2    Alteration in travel scheme or time schedule

The Organiser shall inform the Traveller about alterations in the travel scheme. If the Organiser is not aware of the place of stay, the Traveller shall only be informed through the e-mail address and mobile phone number that is known to the Organiser.

13.3    Duty to report about complaints

The Traveller shall report to the Travel service provider and the Organiser in accordance with article 17 [complaints] without undue delay about the lack of conformity of a Travel service specified in the Contract.

13.4    Remedy by the Organiser

The Organiser shall remedy the reported lack of conformity. There is no obligation to remedy the lack of conformity if this is impossible or this entails disproportionate costs.

13.5    Compensation

If the lack of conformity cannot be solved, the Organiser (or Travel service provider) will discuss the situation with the Traveller and when appropriate offer compensation or an alternative. The Traveller is not entitled to compensation or an alternative when the lack of conformity is attributable to the Traveller.

Article 14 – Assistance

14.1    Obligation to provide assistance

The Organiser provides assistance to the Traveller in difficulty, in particular by providing appropriate information on health services, local authorities and consular assistance and by assisting the Traveller to make distance communications and helping to find alternative travel arrangements.

14.2    Costs

The Organiser shall charge a reasonable fee if the difficulty is caused by the Traveller with intent or through its negligence.

Article 15  Attribution, force majeure and limitations to liability

15.1    Attribution & force majeure

The Traveller shall not be entitled to compensation for damages of the Traveller as a result of a lack of conformity that is attributable to:

a. the Traveller;

b. a third party unconnected with the provision of the Travel services included in the Contract and the lack of conformity is unforeseeable or unavoidable, or;

c. unavoidable and extraordinary circumstances.

15.2    Limitation to liability

Liability of the Organiser for damages is limited to three times the price of the Trip, unless the damage is a result of death of personal injury of the Traveller or caused intentionally or with negligence of the Organiser.

15.3    Limitations to liability based on international conventions and EU regulations

If the Organiser is liable for damages, including damages that are a result of death or personal injury, this liability will be excluded or limited up to the limitations that are allowed by the international conventions and/or EU regulations that are applicable to the concerned Travel service.

15.4    Insured damage

The Organiser is not liable for damages that are covered by an insurance, such as health care insurance, travel insurance, event insurance or cancellation insurance.

15.5    Limitation period (verjaring)

The period for introducing claims of the Traveller to compensation for damages and other claims is two years after the end of the Trip. If the Trip has not taken place the claim period ends two years after the planned date of departure. 

15.6    Expiration period (verval van recht)

Without prejudice to the limitation period and the duty to complaint in timely manner, all claims for damages of the Traveller expire three years after the start of the Trip.

15.7    No accumulation of compensation

The Traveller is not entitled to double compensation. If compensation for damages is indebted based on international conventions or EU regulations the Traveller will not also receive compensation based on this contract.

Article 16 – Obligations of the Traveller

16.1    Behaviour and compliance with instructions

The Traveller shall behave as a reasonably acting Traveller and is obligated to comply with all instructions of the Organiser or Travel service providers.

16.2    Consequences of non-compliance – exclusion from participation

In case of non-compliance of the instructions or in case the Traveller causes nuisance, the Organiser and Travel service provider can exclude the Traveller from further participation on the Trip or a part thereof. The Traveller has to pay all costs and damages the Organiser has incurred as a result thereof. Other costs that arise are at the expense of the Traveller. 

16.3    Warning

Before excluding the Traveller from participation an oral or Written warning is given. A warning is not required if this is not appropriate considering all circumstances of the case.

16.4    Liability of the Traveller and indemnification

The Traveller is liable for damages caused by his behaviour, non-compliance with the obligations of this article or damage that are otherwise attributable to him. The Traveller indemnifies the Organiser from claims from Travel service providers involved with the Trip, other Travellers or third parties for damages that are caused by the Traveller or are attributable to him.  

16.5    Check departure time of the return journey

Ultimately 24 hours before the planned departure of the return journey the Traveller has to verify the exact departure time.

16.6    Formal health requirements

The Traveller has to fulfil all health requirements demanded by the country of destination and countries of transit. Governments can change these requirements at any time without prior announcement. The effects of these changes fall within the risk of the Traveller.

16.7    Measures taken by Travel service providers

Travel service providers can take all reasonable measures and require cooperation from the Traveller, amongst others to prevent and combat hazards, to reduce health risks, to prevent damage and/or to comply with government regulations. Non-compliance of the measures or instructions can lead to an exclusion of the Traveller from the Travel service and property.

16.8    Use of property

The Traveller shall use the provided property in a correct manner. Upon reception of the property the Traveller has to inspect it. Defects have to be notified immediately. The Traveller is liable for any damage, loss or theft of the provided property.

Article 17 - Complaints

17.1    Information

Before the start of the Trip the Organiser provides emergency contact details of the Organiser.

17.2    Report on site

If the Traveller perceives that the Trip is not performed properly, he has to report the lack of conformity immediately to the Travel service provider involved in order to enable them to resolve it. The complaint shall also immediately be reported to the Representative of the Organiser (host). If there is no representative present on site or the complaint entails the representative, the complaint has to be reported to the Organiser by Whatsapp or during Working days within Dutch office hours (9-17h) also per e-mail info@base2go.com  

17.3    Costs of communication

The Traveller shall limit possible communication costs, amongst others by using internet calls, Whatsapp and e-mail.

17.4    Report of unresolved complaints after the Trip

All complaints that in the perception of the Traveller are not fully resolved or compensated during the Trip, shall be reported to the Organiser within two months after the Trip, in Writing and mentioning the reasons.    

17.5    Consequences of not reporting (on time) the lack of conformity or complaint

Not reporting the complaint or not reporting the complaint on time in accordance with the second paragraph [Report on site] of this article can be of influence on the amount of a possible compensation, unless the interests of the Organiser are not impaired by the late complaint. Late complaints after the return of the Trip will not be processed, unless this is unreasonable considering the circumstances.

Article 18 – Photo’s, video’s and off- and online publications.

18.1    Images and use thereof

The Trip offered by the Organiser is organised in collaboration with influencers who use online social media. By participating on the Trip you agree that you are photographed and filmed in public space and shared facilities and that you may appear in online social media productions of the influencers or of online or offline marketing/publications of the Organiser. This extends to images and use thereof that you may reasonably expect. It does not extend to your private space/room and does not extend to images or publication that is indecent.

18.2    Your images - Private use only

The images (photo’s and video’s) you make or obtain of the trip may be used for private purposes only. Any commercial activity or commercial exploitation of these images is forbidden without prior permission of the Organiser

Article 19 – Miscellaneous provisions

19.1    Rights of third parties

Subordinates, auxiliaries and other parties involved in the performance of the Contract can rely on the provisions of this Contract and these Terms & conditions in relation to the Traveller (including the limitation of liability).

19.2    Substitute provisions

If mandatory provisions of law render a provision of these Terms & conditions invalid, or a provision is annulled, the provision is deemed to have been converted to a valid provision that has a content and meaning that as close as possible reflects the original intentions.

19.3    Governing law

The offer, the Contract and the performance of the Contract are exclusively governed by the law of the Netherlands, unless this is in conflict with mandatory provisions of law.

If the consumer has his habitual residence outside of the Netherlands at the time of booking, the following applies:

Without prejudice to this choice of law, the consumer will be protected by mandatory provisions of the law of his country of residence when (cumulative):

-the Organiser directs his commercial activities regarding the Contracted Trip to the Country of residence of that consumer

- the contracted Travel services are partially or entirely provided in that country.  

19.4    Jurisdiction

The court of law within whose working area the Organiser is established, shall have exclusive jurisdiction regarding the contract and all related matters, unless this conflicts with mandatory provisions of law. Additionally the Organiser may choose to file a law suit against the Traveller in the court district of their habitual residence.

Article 1 - Definitions

Organiser: Base2Go registered under Chamber of Commerce number 98238213

Traveller: any person who is seeking to conclude a Contract with the Organiser or any person who is entitled to travel on the basis of the Contract.

Travel service: the services that are part of the Trip, such as carriage of passengers, rental of motor vehicles, accommodation and excursions.

Travel service provider: The service provider that executes part of the Trip such as facilitators of accommodation, transport service providers, external guides, etc.). 

Contract: the agreement regarding the booked Trip, including these Terms & conditions.

Written: in writing or by electronic means including e-mail.

Terms & conditions: these General Terms and conditions.

Package: a travel package (“pakketreis”) in the sense of article 7:500 sub b of the Dutch Civil Code.

Trip: a package or if the Terms & conditions are applied a sole Travel service, including trips, retreats, journeys, tours.

Working days: Monday to Friday, with the exemption of Dutch public holidays, within office hours (9h-17h Dutch time).

Article 2 – Applicability of the Terms & conditions

2.1      Package travel
The Terms & conditions are applicable to all Packages offered by or concluded with the Organiser.
2.2     Derogation of the Terms & condition and additional terms and conditions
Derogation of the Terms & condition and additional terms and conditions are only valid in Written form and are superseding the conditions in these Terms & conditions.

Article 3 – Formation of the contract

3.1     Content of the offer

The offer of the Trip only contains the services and facilities that are explicitly mentioned in the offer and publications of the Organiser. Information in publications of Travel service providers are not part of the offer, whether or not there is a link provided to these publications in the offer of the Organiser. The period of the Trip is stated in whole days. The day of departure and arrival are counted as whole days.

3.2     Non-binding offer

The offer made by the Organiser is non-binding. After the offer has been accepted, the offer can be revoked by the Organiser until 17.00h of the next Working day.

3.3     Booking

De Contract is concluded after the Traveller has accepted the offer of the Organiser and subject to availability of the Trip.  

3.4     Apparent errors

Apparent errors in the offer do not bind the Organiser. If there is any reason for doubt, the Traveller should enquire with the Organiser.

3.5     Preferences

Preferences communicated by the Traveller are non-binding and do not create rights, unless the Organiser confirms in Writing that the preference shall be honoured. The sole reference as a preference on travel documents and the booking confirmation does not constitute this acceptance.

3.6     Special requirements

If the Traveller communicates medical requirements or other compelling interests as a ‘requirement’ to the Organiser before booking, the Organiser shall assess whether or not it can comply. If the Organiser cannot or does not want to comply, the contract shall not be concluded. The Organiser can alter the price of the trip due to the communicated requirements.

3.7     Confirmation of the booking

The Organiser will send a confirmation of the booking after the booking of the Trip and the check of availability.    

3.8     Revocation by the Traveller

A booking made by the Traveller is irrevocable. The Traveller has no right of withdrawal of the Contract.

3.9     Minors

The person who books and the Traveller who travels, has to be adult (18 yrs. or older).

3.10    Booking for other Travellers & communication

The Traveller that books for other Travellers, is fully liable for all obligations that arise from it. The other Travellers are liable for their own part. The booking confirmation, invoice, travel documents and other communication are only send to the Traveller that made the booking. The Traveller who books the Trip for others, is obligated to communicate all relevant personal information of those other Travellers. The Traveller who books the Trip for others, is obligated to send these Terms & conditions and all other relevant communication to those Travellers. The Traveller that made the booking indemnifies the Organiser for all damages that arise as a result of not performing the obligations stipulated in this provision.

Article 4 - Information provided by the Organiser

4.1     Price

Indicated prices are per person, unless specifically stated otherwise.

4.2     Information during the booking process

Before or immediately after the conclusion of the Contract the Organiser provides the Traveller the Contract including accepted preferences, information on the travel documents needed (passport, visa, etc.) and health related formalities. This information is based on the Dutch nationality.

4.3     Travel documents

During the Trip the Traveller shall possess the necessary Travel documents, such as a passport, visa, vaccination, etc.. Due to the great importance, the Traveller has to verify with the relevant authorities whether the information is complete and up to date. The Traveller has to verify before booking whether or not there is sufficient time to obtain the necessary travel documents. If the Traveller cannot execute the Trip or parts of it due to the absence of the required travel documents, the arising costs will be borne by the Traveller.

4.4     Travel vouchers

The travel vouchers (transport tickets, vouchers, etc.) will be send to the Traveller at least 7 days before departure unless the invoice is not yet fully paid. If a Traveller has not received their travel vouchers 5 days before departure the Traveller has to inform the Organiser immediately.

4.5     Information on insurance

You must take out a comprehensive travel insurance policy that includes medical expenses, accidents, and repatriation. This must also cover the sporting and adventurous activities. Additionally, we recommend taking out a cancellation insurance policy.

Article 5 – Information to be provided by the Traveller

5.1     Relevant information of the Traveller(s)

Before booking the Traveller who books the Trip provides all relevant information of the Travellers. In particular information that can be of influence to the health and safety of the Traveller or others. If the information provided is incorrect or incomplete the Traveller can be excluded from participation. In that case the Traveller has to pay all costs and damages the organiser has incurred. Other costs arising from this will be borne by the Traveller as well.

5.2     Reduced mobility, pregnant women and illness

Travellers with reduce mobility and the persons that accompany them, pregnant women, and Travellers with illness with a possible effect on the Trip have to indicate this to the Organiser before the conclusion of the Contract or at least as soon as the Traveller takes notice because of possible effects on the Trip and especially air travel. The Traveller has to verify themselves if they need a medical statement that allows them to travel.

Article 6 - payment

6.1     Down payment

The Organiser will require a down payment as stated in the offer, which is due upon booking.

6.2     Payment of the remaining amount

The remaining amount of the price of the Trip has to be received by the Organiser at the latest 8 weeks before the start of the Trip. If the Trip is booked within 8 weeks before the start of the Trip, the full price shall be paid immediately after booking. In all circumstances full payment has to be received before the start of the Trip.

6.3     Default and interest

If the Traveller has not paid before the agreed term, the Traveller shall be in default without any prior notice of default. From that moment statutory interest is due over the outstanding amount.

6.4     Extrajudicial collection costs

The Traveller has to pay extrajudicial collection costs if the Traveller has not paid before the final date, which was communicated by means of a formal Written reminder. The extrajudicial collection costs are: 15% of the amount of the claim up to € 2500, 10% of the subsequent €2500, 5% of the subsequent €5000 and 1% of the excess amount of the claim.

6.5     Further consequences of non-payment

As long as the Traveller has not paid the due amount, the Organiser can suspend sending the travel vouchers without further notice. If payment is not made after having send a formal reminder or if full payment has not been received before the start of the Trip, the Organiser can exclude the Traveller from participation. The obligation to pay remains in force. Instead of excluding the Traveller from participating, the Organiser can cancel the Contract and claim all costs and damages it has incurred.

Article 7 – Transfer of the Trip

7.1     Conditions and notification

A Traveller can transfer the Trip to another person who meets all conditions applicable to the Trip. Transfer of the Trip is only possible as far as the terms and conditions of the Travel service providers allow this. If flight tickets are part of the Trip, then transfer of the flight ticket is often not possible. Transfer of the whole Trip is then only possible if a new flight ticket is booked at the expense of the Traveller. The Traveller shall request the transfer at the latest 7 days before the start of the Trip.

7.2     Joint and several liability and extra costs

The Traveller and the person who agrees to take over the Trip, have a joint and several liability for the payment of the price and additional costs that arise as a result of the transfer, including costs for the alteration.

Article 8 – Alteration requested by the Traveller

8.1     Alteration

The Traveller who has booked the Trip can request the Organiser in Writing to alter the Contract. The Organiser is not bound to alter the Contract. The Organiser will inform the Traveller of the new price for the Trip. If the Traveller agrees on the costs of the alteration than the new price and alteration costs are due. If the new price is lower than the initial price then the difference is offset with the alteration costs.

8.2     Changing the date of departure

Unless the Organiser states the alteration constitutes a rebooking, the change of the departure date constitutes a cancellation of the contract and the conclusion of a new contract. The cancellation policy as set out in article 9 paragraph 2 [cancellation costs] is applicable to the cancelled contract.

Article 9 – Cancellation by the Traveller

9.1     Cancellation
The Traveller can cancel the booking at any time before the start of the Trip. The cancellation shall be in Writing. The day of reception of the cancellation by the Organiser, shall constitute the cancellation date. When the reception occurs after 17.00h (Amsterdam-time) or outside of Working days, the next Working day shall be the day of reception of the cancellation.
9.2     Cancellation costs
If the Traveller cancels the trip, the Traveller is due:
a. until 85 days before the day the Trip starts: the downpayment. 
b. from 84 days up to 46 days before the day the Trip starts: 50% of the price of the Trip. 
c. from 45 days up to 22 days before the day the Trip starts: 75% of the price of the Trip. 
d. from 21 days before the start of the Trip: 100% of the price of the Trip.
9.3     Decreasing the number of travellers
When decreasing the number of Travellers within in a booking, the Organiser can, at its own choice, charge either one of the following cancellation costs:

  1. the standard cancellation costs as stipulated in paragraph 2 of this article;

  2. the full price of the cancelled Trip minus any savings as a result of the cancellation.   

9.4     Cancellation costs when cancelling a rebooked Trip
In the event the Traveller and Organiser rebook the Trip to a later moment the following applies: If the Traveller cancels the rebooked Trip, the cancellation costs shall at least be the amount the Traveller would have to pay if the Traveller would have cancelled the day of rebooking.
9.5     Travel credits based on leniency policy
If the Trip is cancelled by the Traveller and out of leniency travel credits are attributed to the Traveller, the following provisions apply (unless other provisions are communicated):

  • the travel credit shall be used within one year after its issue.

  • the new Trip has to commence within two years after the issue of the travel credit.

  • the travel credit is personal and not transferable.

  • the travel credit can only be used for the same Trip at a later moment.

  • if the Trip is more expensive at a later moment, the price difference will be charged to the Traveller.

  • If the Traveller cancels a Trip that is booked with travel credits that were issued out of leniency, the travel credit expires.

Article 10 – Alteration of the price

10.1    Alteration of the price

The Organiser can increase the price of the Trip until 20 days before the start of the Trip due to a price revision of:

-the cost of fuel or other power sources, or;

- taxes or fees imposed by third parties not directly involved in the performance of the Contract.

The Organiser can reserve the right in the Contract to increase the price of the Trip until 20 days before the start of the Trip as a consequence of changes in the exchange rate. The method for calculating the price revision shall be included in the Contract.

10.2    Termination by the Traveller

If the price increase exceeds 8% of the Price of the Trip, the Traveller can terminate the Contract. In that case the paid price of the Trip is refunded to the Traveller.

10.3    Price reduction

If the right to a price increase is agreed, the Traveller has a corresponding right to a price reduction. An administrative expense of 30 euro shall be deducted from the refund that the Traveller is entitled to based on the price reduction.

Article 11 – Alterations made by the Organiser

11.1    Alteration

The Organiser can unilaterally make changes to the Contract before the start of the Trip as far as these alterations are insignificant. These alterations will be communicated to the Traveller.

11.2    Significant alteration

If necessary the Organiser can alter significantly the main characteristics of the Contract before the start of the Trip. This includes offering a substitute Trip. The Traveller can accept the alteration or cancel the Contract without payment of cancellation costs. If cancelled, the paid price of the Trip is refunded to the Traveller. The Organiser may specify a reasonable period within which the Traveller has to communicate its choice. If the Contract is not cancelled within the specified period, the alteration shall be deemed accepted and the right to cancel the Contract expires.

Article 12 – Cancellation by the Organiser

12.1    Minimum number of Travellers

The Organiser can cancel the Contract before the start of the Trip, if the number of persons enrolled for the Trip is smaller than the minimum number stated in the Contract and the Organiser notifies the Traveller of the cancellation of the Contract not later than:

- 20 days before the start of the Trip in case the Trip lasts more than 6 days

- 7 days before the start of the Trip in case the Trip lasts between 2 and 6 days

- 48 hours before the start of the Trip in case the Trip lasts less than 2 days

12.2    Cancellation due to Force Majeure

The Organiser can cancel the Contract before the start of the Trip, in the event of force majeure, which is defined as unavoidable and extraordinary circumstances.

12.3    Refund of the price of the Trip – no compensation for damages

In the aforementioned events, the Organiser will refund the payment of the Trip within 14 days and no compensation for damages is due. No refund will be made for services not included in the Contract such as vaccinations, visa, materials bought, insurance and if not included in the Trip flights, tickets, accommodation, a.s.o..

12.4    Cancellation that is attributable to the Traveller

If the Traveller does not meet the predefined conditions of participation or the information of the Traveller regarding experience, skills, physical or mental condition or other relevant subjects that has been communicated is incomplete or erroneous, the Organiser can cancel the Contract. The Traveller has to pay all costs and damages the Organiser has incurred due to the cancellation.

Article 13 – Responsibility & lack of conformit

13.1    Proper performance of the Trip

The Organiser is responsible for the performance of the contracted Travel services, irrespective of whether those services are to be performed by the Organiser or by other Travel service providers. The Organiser shall perform the Contract in accordance with the reasonable expectations of the Traveller based on the publications, the Contract and the circumstances at the destinations.

13.2    Alteration in travel scheme or time schedule

The Organiser shall inform the Traveller about alterations in the travel scheme. If the Organiser is not aware of the place of stay, the Traveller shall only be informed through the e-mail address and mobile phone number that is known to the Organiser.

13.3    Duty to report about complaints

The Traveller shall report to the Travel service provider and the Organiser in accordance with article 17 [complaints] without undue delay about the lack of conformity of a Travel service specified in the Contract.

13.4    Remedy by the Organiser

The Organiser shall remedy the reported lack of conformity. There is no obligation to remedy the lack of conformity if this is impossible or this entails disproportionate costs.

13.5    Compensation

If the lack of conformity cannot be solved, the Organiser (or Travel service provider) will discuss the situation with the Traveller and when appropriate offer compensation or an alternative. The Traveller is not entitled to compensation or an alternative when the lack of conformity is attributable to the Traveller.

Article 14 – Assistance

14.1    Obligation to provide assistance

The Organiser provides assistance to the Traveller in difficulty, in particular by providing appropriate information on health services, local authorities and consular assistance and by assisting the Traveller to make distance communications and helping to find alternative travel arrangements.

14.2    Costs

The Organiser shall charge a reasonable fee if the difficulty is caused by the Traveller with intent or through its negligence.

Article 15  Attribution, force majeure and limitations to liability

15.1    Attribution & force majeure

The Traveller shall not be entitled to compensation for damages of the Traveller as a result of a lack of conformity that is attributable to:

a. the Traveller;

b. a third party unconnected with the provision of the Travel services included in the Contract and the lack of conformity is unforeseeable or unavoidable, or;

c. unavoidable and extraordinary circumstances.

15.2    Limitation to liability

Liability of the Organiser for damages is limited to three times the price of the Trip, unless the damage is a result of death of personal injury of the Traveller or caused intentionally or with negligence of the Organiser.

15.3    Limitations to liability based on international conventions and EU regulations

If the Organiser is liable for damages, including damages that are a result of death or personal injury, this liability will be excluded or limited up to the limitations that are allowed by the international conventions and/or EU regulations that are applicable to the concerned Travel service.

15.4    Insured damage

The Organiser is not liable for damages that are covered by an insurance, such as health care insurance, travel insurance, event insurance or cancellation insurance.

15.5    Limitation period (verjaring)

The period for introducing claims of the Traveller to compensation for damages and other claims is two years after the end of the Trip. If the Trip has not taken place the claim period ends two years after the planned date of departure. 

15.6    Expiration period (verval van recht)

Without prejudice to the limitation period and the duty to complaint in timely manner, all claims for damages of the Traveller expire three years after the start of the Trip.

15.7    No accumulation of compensation

The Traveller is not entitled to double compensation. If compensation for damages is indebted based on international conventions or EU regulations the Traveller will not also receive compensation based on this contract.

Article 16 – Obligations of the Traveller

16.1    Behaviour and compliance with instructions

The Traveller shall behave as a reasonably acting Traveller and is obligated to comply with all instructions of the Organiser or Travel service providers.

16.2    Consequences of non-compliance – exclusion from participation

In case of non-compliance of the instructions or in case the Traveller causes nuisance, the Organiser and Travel service provider can exclude the Traveller from further participation on the Trip or a part thereof. The Traveller has to pay all costs and damages the Organiser has incurred as a result thereof. Other costs that arise are at the expense of the Traveller. 

16.3    Warning

Before excluding the Traveller from participation an oral or Written warning is given. A warning is not required if this is not appropriate considering all circumstances of the case.

16.4    Liability of the Traveller and indemnification

The Traveller is liable for damages caused by his behaviour, non-compliance with the obligations of this article or damage that are otherwise attributable to him. The Traveller indemnifies the Organiser from claims from Travel service providers involved with the Trip, other Travellers or third parties for damages that are caused by the Traveller or are attributable to him.  

16.5    Check departure time of the return journey

Ultimately 24 hours before the planned departure of the return journey the Traveller has to verify the exact departure time.

16.6    Formal health requirements

The Traveller has to fulfil all health requirements demanded by the country of destination and countries of transit. Governments can change these requirements at any time without prior announcement. The effects of these changes fall within the risk of the Traveller.

16.7    Measures taken by Travel service providers

Travel service providers can take all reasonable measures and require cooperation from the Traveller, amongst others to prevent and combat hazards, to reduce health risks, to prevent damage and/or to comply with government regulations. Non-compliance of the measures or instructions can lead to an exclusion of the Traveller from the Travel service and property.

16.8    Use of property

The Traveller shall use the provided property in a correct manner. Upon reception of the property the Traveller has to inspect it. Defects have to be notified immediately. The Traveller is liable for any damage, loss or theft of the provided property.

Article 17 - Complaints

17.1    Information

Before the start of the Trip the Organiser provides emergency contact details of the Organiser.

17.2    Report on site

If the Traveller perceives that the Trip is not performed properly, he has to report the lack of conformity immediately to the Travel service provider involved in order to enable them to resolve it. The complaint shall also immediately be reported to the Representative of the Organiser (host). If there is no representative present on site or the complaint entails the representative, the complaint has to be reported to the Organiser by Whatsapp or during Working days within Dutch office hours (9-17h) also per e-mail info@base2go.com  

17.3    Costs of communication

The Traveller shall limit possible communication costs, amongst others by using internet calls, Whatsapp and e-mail.

17.4    Report of unresolved complaints after the Trip

All complaints that in the perception of the Traveller are not fully resolved or compensated during the Trip, shall be reported to the Organiser within two months after the Trip, in Writing and mentioning the reasons.    

17.5    Consequences of not reporting (on time) the lack of conformity or complaint

Not reporting the complaint or not reporting the complaint on time in accordance with the second paragraph [Report on site] of this article can be of influence on the amount of a possible compensation, unless the interests of the Organiser are not impaired by the late complaint. Late complaints after the return of the Trip will not be processed, unless this is unreasonable considering the circumstances.

Article 18 – Photo’s, video’s and off- and online publications.

18.1    Images and use thereof

The Trip offered by the Organiser is organised in collaboration with influencers who use online social media. By participating on the Trip you agree that you are photographed and filmed in public space and shared facilities and that you may appear in online social media productions of the influencers or of online or offline marketing/publications of the Organiser.
